OSG intervenes in Cebu demolition raps

CEBU CITY, May 4 – The Office of the Solicitor General (OSG) has intervened in the case against the owner of the 4.7-hectare lot in Barangay Apas, where the houses of 168 families are scheduled to be demolished on Monday.

OSG has asked the Regional Trial Court (RTC) Branch 9 to stop the implementation of the writ of demolition for at least 30 days from May 7 to June 6 to give the State enough time to present new evidence.

In its urgent motion to stay the execution of the writ of demolition, the OSG said there were several documentary evidences that were discovered recently, which proved the government’s ownership of the property.

The documents “raise serious conjectures regarding the legality of Mariano Godinez’s Torrens Title,” the OSG said.

It said the court may not even have acquired jurisdiction over the person of Godinez in the case.

The OSG clarified that the State will file a case that will prove its ownership of the property, and lawfully recover the title.

Rep. Tomas Osmeña (Cebu City, south district), Vice Mayor Joy Augustus Young and councilor Alvin Dizon informed the affected residents of the new development on the case.

The concerned families, who are members of the Archangel Residences Mergence Inc. (Armi), applauded when former mayor Osmeña, Young and Dizon made the announcement.

Armi president Ignacio Labro said they were happy the OSG has intervened in the case so their side would also be heard.

He believes they are occupying a lot owned by the National Government, and not by Godinez, who they said they have never seen.(PNA) RMA/EB/re
