Hacienda Luisita case tossed to SC en banc; sets oral arguments on August 3

MANILA, July 20 — The Supreme Court (SC) on Tuesday decided to transfer the Hacienda Luisita case from the First Division to the SC en banc, SC Spokesman and Court Administrator Atty. Jose Midas Marquez told a press conference.

Marquez said the oral arguments will probably be conducted on Aug. 3, 2010.

He added that the necessary resolution on the matter will be issued by the Court.

Considering the importance of the Hacienda Luisita case and the parties involved, Marquez said, Chief Justice Renato Corona thought that it would be best that the whole Court is consulted on the case.

Chief Justice Corona is part of the SC First Division.

"It's (oral arguments) being called by the Court on its own," Marquez said.

Marquez stressed that Corona was the one who scheduled the oral arguments on August 3 so that all the parties will be called to explain and all the issues will be threshed out.

The transfer of the case, Marquez said, is aimed at threshing out particular issues on the case and clarificatory questions will be addressed.

"It's already also ripe for decision. All the issues have been 'joined', as in legal parlance. It's up for decision already," Marquez said.

Likewise, Marquez clarified that definitely, the transfer has nothing to do with President Benigno Simeon "Noynoy" Aquino III.

The Cojuangco family, from which the late President Corazon Cojuangco Aquino belonged, owns the Hacienda Luisita. (PNA)
