MANILA, Jan. 22 –- The Quezon City Metropolitan Trial Court (QCMTC) Branch 35 on Friday afternoon said the arraignment of Marlene Aguilar, mother of road rage suspect Jason Ivler, has been set on the third week of February.

A staff of QCMTC branch 35 Judge Voltaire Agas, who requested anonymity, said obstruction of justice case against Aguilar is being transmitted from the National Bureau of Investigation.

Aguilar, younger sister of folk singer Freddie Aguilar, has been charged with the offense by NBI after she allegedly hid her son from authorities.

The case was formally filed before QCMTC a day after Ivler shot it out with NBI agents and was eventually injured during the attempt to arrest him at the family home in Blue Ridge Quezon City.

Meanwhile, the Ebarle Family on Friday said they don’t expect anymore an apology from the Ivler Family but the most important thing is, road rage suspect Jason Ivler has been arrested.

Presidential Chief of Staff Undersecretary Renato Ebarle Sr. said over radio station DZRH: “we don’t expect Jason Ivler’s parents to offer their apology but we are greatful the authorities have arrested him for killing my son, Renato Victor Jr. last November 18, 2009.”

Earlier Aguilar on Friday claimed her son was set up by her British bodyguard for the murder of the only son and namesake of Malacañang official Renato Ebarle Sr. last November 18, 2009.

Aguilar told reporters her British bodyguard had access to their vehicles, to Ivler's room and his gun.

"My bodyguard, who a is foreigner and also bald headed (like my son). His room was beside Jason's room. He has access to the car keys, to the car. He has access to the gun. He has access to my house," Aguilar claimed.

The gun Aguilar was referring to was the same gun seized by agents of the National Bureau of Investigation (NBI), a high end Kimber .45 pistol and an Ar 50 fifle, during the Monday morning raid at her house in Blue Ridge village in Quezon City.

She identified her former British bodyguard as a certain Mark Hausser. She added that her bodyguard was former member of the British military.

“My bodyguard could have set up Jason,” she said, adding that they have someone who can prove that Ivler was in a bar when Ebarle Jr. was killed. (PNA)V3/JCA
