SAN JOSE, ANTIQUE, June 16 — Charges of Homicide, Frustrated Homicide and Assault on Persons of Authority were filed against Tyrone Jonathan Garcia who figured in a shoot-out with policemen last Saturday afternoon.

The incident happened right in the PNP station, causing the instant death of tricycle driver identified as Randy Dela Cruz, a resident of Funda-Dalipe, San Jose and the wounding of Leonora Calipayan who went to the PNP station to visit her detained father.

According to Insp. Ephraim Roxas, Deputy Station Commander of San Jose PNP, the suspect went inside the PNP Station following Calipayan who the desk officers thought was in the company of the victim who went to visit her detained father.

“PO3 Edwin Elizalde approached them to ask for the purpose of the visit which was the standard practice in the police station but without any provocation, Garcia grappled with the service firearm of PO3 Elizalde and ran out of the building. PO3 Elizalde went after the suspect. Then he shot the police officer but missed PO3 Elizalde and instead hit Leonora Calipayan who was there standing at the lobby. She was hit at the lower butt,” Roxas said.

It was then, according to Roxas that PO2 Larry Pendon chased and shot Garcia who fired back at him, hitting a tricycle driver identified later as Randy Dela Cruz who succumbed to a fatal hit in the head.

“Garica then ran towards the back of the PNP station building and was chased by other police officers among them PO3 Elizalde and PO2 Roxas. Upon reaching ATM Day Mart, some 100 meters away from the station, Garcia took Security Guard Elorde Valenzuela. It was then that the ensuing police officers noticed Garcia’s firearm was already empty that they subdued him.

Garcia, 38 years old, single, resident of Rizal Street, Poblacion, Belison and a former convict who was freed on Parole last Feb. 9, 2012 is presently detained at the San Jose lock up cell and is due for transfer to the BJMP Cell anytime soon.

On the other hand, the victim Dela Cruz was brought to the funeral parlor while the other victim is now undergoing treatment at the Angel Salazar Memorial General Hospital.(PNA)
