SC junks with finality Zaldy Ampatuan's plea for exclusion from Maguindanao massacre raps

MANILA, Dec. 5 — The Supreme Court has dismissed with finality the second motion for reconsideration (MR) filed by former Autonomous Region in Muslim Mindanao (ARMM) Gov. Zaldy Ampatuan to be excluded in the list of the accused in the Maguindanao massacre case.

The massacre claimed the lives of 57 civilians, including 15 women and 30 media practitioners in Ampatuan town, Maguindanao on Nov. 23, 2009.

In a three-page notice of resolution issued by the SC Third Division dated Nov. 14, 2012 and signed by Division Clerk of Court Atty. Lucita Soriano, the SC denied with finality the second MR filed by Zaldy Ampatuan for lack of merit.

In his motion, Zaldy asked the SC for an explanation on the dismissal of the petition for review and motion for reconsideration he filed, which were dismissed on June 25, 2012 and Aug. 15, 2012, respectively.

He argued that he was denied due process when the SC did not state the facts of the law which were used as basis in the assailed decisions.

However, the SC said that it did not need to make an explanation because it found that the lower court did not err its decision.

Likewise, the SC said that the facts of the law have also been tackled in the decision of the Court of Appeals. (PNA)
