Macalintal supports call on term limit to party-list reps

MANILA, July 12 – An election lawyer has supported the call for the Commission on Elections (Comelec) to resolve the issue in providing a term limit to party-list representatives.

“Dapat talaga maresolve ang bagay na yan. Party-list ang kandidato sa congressman. Sa batas, dapat three-term limit. So kung ganon, talagang tama ang direction ng Comelec na dapat tingnan yung area na yun,” said Atty. Romulo Macalintal.

However, he noted that the poll body cannot moto propio act and limit the term of office of the representatives of the marginalized sector in the House of Representatives. A petition has to be filed before the Comelec.

“But somebody, I think, should file a case before the Comelec questioning, halimbawa yung qualification of a particular party-list who had already served for three consecutive terms. Hindi pupuwedeng on its own ay gawin ng Comelec yun not moto propio,” he explained.

Macalintal said that if the Comelec would make a statement, they might be accused of pre-judging a particular case.

He pointed out that the Constitution states that members of the House of Representative should be three consecutive terms.

“And the constitution does not make any distinction. It only said the three-term shall apply to a member, a party list is a member of the House, di ba?” Macalintal asked.

He noted that once a party-list representative seats in Congress, he/she automatically becomes a member of Congress.

“Talaga namang hindi sila iba. The moment you are in Congress, pare-pareho na kayo dun. You are all members of Congress. They just have different constituents,” Macalintal said. (PNA)
