MANILA, Jan. 2 – “Surrender first before asking for relief,” the Malolos City, Bulacan Regional Trial Court (RTC) on Monday said as it refused to act on the motions filed by former Bantay party-list representative and retired Army Maj. Gen. Jovito Palparan, Jr.

Palparan, together with Master Sgt. Rizal Hilario who is also at-large, and Lt. Col. Felipe Anotado and Staff Sgt. Edgardo Osorio are facing charges for kidnapping and serious illegal detention for the abduction of still missing University of the Philippines (UP) students Karen Empeno and Sherlyn Cadapan.

Empeno and Cadapan were allegedly abducted in Hagonoy, Bulacan on June 26, 2006. They have been missing then.

Malolos City RTC Branch 14 Presiding Judge Teodora Gonzales on Monday said that Palparan “cannot seek relief, if at all, unless they surrender or arrested.”

Palparan filed an omnibus motion for new preliminary investigation, a motion for the quash of the arrest warrant, hold departure order (HDO) and suspension of the proceedings in court.

The next hearing of the case was set on Feb. 6, 2011. (PNA) RMA/PTR/utb
