Nograles asks Comelec to annul proclamation of his rival in the Davao mayoralty race

MANILA, May 24 – Saying that the May 10 polls was marred with irregularities, losing mayoralty candidate House Speaker Prospero Nograles on Monday asked the Commission on Elections (Comelec) to cancel the proclamation of his rival and elected Davao City Mayor Sara Duterte.

“The protestant prays that the Comelec annul the proclamation of protestee as mayor of the City of Davao and direct her to immediately vacate the position and to cease and desist from discharging the duties and functions of that office,” he said, in a 14-page petition.

Nograles also asked the poll body to declare him as the winner in the mayoralty race in the said province.

Likewise, he said the poll body should take custody of all ballot boxes, compact flash cards and other paraphernalia used in the last elections.

“No full-proof measure was ever taken to ensure the integrity and security of the automated elections despite the fact that election results could be changed by modifying the contents of the CF cards,” Nograles said.

The lawmaker added that the removal of the required digital signatures of the Board of Election Inspectors (BEIs) in the electronically-transmitted election returns (ERs) has put doubts as to whether the transmitted results came from legitimate PCOS machines or not.

The Davao City Board of Canvassers had already proclaimed Duterte as the winning candidate for having obtained a total of 388,465 compared to Nograles’ 160,225 votes. (PNA)
