CA dismisses Leviste's plea

MANILA, May 19 – The Court of Appeals (CA) has dismissed the petition of former Batangas Governor Antonio Leviste for a reversal of the ruling of the Makati City Regional Trial Court (RTC).

Judge Elmo Alameda of the Makati City Regional Trial Court Branch 150 sentenced governor Antonio Leviste to 12 years in prison for shooting to death his long-time buddy Rafael delas Alas in his office in LPL Tower in Legaspi Village, Makati City on Jan. 12, 2007.

In a 30-page decision, the CA dismissed the petition filed by Leviste due to lack of merit.

In its ruling, the CA said that it was not convinced by the argument of Leviste that he only acted in "self defense" that caused the death of delas Alas.

In his petition, Leviste argued that he only resorted to "self-defense," thinking that delas Alas was about to shoot him.

Nevertheless, the CA said that Leviste failed to prove his alibi, noting that, the evidence gathered show it appears that the firearm of delas Alas was on "safety lever" when he was found dead inside the office of the former governor.

Leviste remains incarcerated at the Makati City Jail. (PNA)
