Lanao del Norte mayor, 2 officials in graft raps

MANILA, April 13 – The Office of the Ombudsman (Ombudsman) on Tuesday filed graft charges before the anti-graft court Sandiganbayan against a mayor of Lanao del Norte and two other officials for their alleged failure to remit Government Service Insurance System (GSIS) monthly premium contributions and Employees Compensation amounting to more than P4 million.

In a three-page charge sheet, approved by Acting Ombudsman Orlando Casimiro, probable cause was found against Magsaysay, Lanao del Norte Mayor Hadji Haron Dereposon Omar.

Likewise, indicted before the Sandiganbayan were Municipal Treasurer Prescila Magsalay Bohol and Municipal Accountant Luz Calunsag Rebojo.

Then Assistant Special Prosecutor and now Cebu City Municipal Trial Court (MTC) Judge Pamela Baring-Uy, investigator of the case, recommended a P30,000-bail for the temporary liberty of each of the accused.

The respondents were accused of violating Section 3E of Republic Act 3019, otherwise known as the Anti-Graft and Corrupt Practices Act for committing undue injury to the government.

"(Respondents)…..did then and there willfully, unlawfully and criminally fail to remit the compulsory monthly premium contributions to the GSIS comprising the personal share, government share and employees compensation of the employees of the Municipality of Magsaysay from calendar years 1997 to 2005 plus interest in the amount of P1,686,672.20 or a total obligation of P4,093,418.02," the charge sheet said.

Despite corresponding deductions made to the salary of the employees, the respondents failed to remit the same to the GSIS.

As such, the employees failed to get their salary loans which caused undue injury to their rights and to the government.

"And, by reason thereof, the granting of salary loan to employees of the Municipality of Magsaysay was suspended, thus causing undue injury and prejudice to the employees of the Municipality of Magsaysay, Lanao del Norte, in the aforesaid amount," it said. (PNA)
