SC defers action on Laguna solon's TRO petition vs. HRET

MANILA, Aug. 25 – The Supreme Court (SC) on Tuesday deferred its action on the temporary restraining order (TRO) petition filed by Laguna Rep. Dan Fernandez seeking to stop the House of Representatives Electoral Tribunal (HRET) from unseating him as a Member of the House of Representatives.

SC Spokesman Atty. Jose Midas Marquez said that during the en banc session on Tuesday, the Court has not yet decided to issue a TRO on the said petition.

Marquez added that the petition will still be deliberated on the next regular session of the SC en banc.

Earlier, in a petition he filed before the SC, Fernandez said that the HRET resolution should be nullified due to grave abuse of discretion on the part of the HRET when the latter made additional requirements for those seeking to be a Member of the House of Representatives.

The HRET in its resolution in December 2008, disqualified Fernandez as the representative of the first district of Laguna for being a resident of the area for only a period of less than one year prior to the May 2007 elections. (PNA)
