JBC names shortlist of nominees for SC post

MANILA, June 22 – The Judicial and Bar Council (JBC) on Monday named the aspirants to its shortlist of nominees for possible appointment to vacant position as Associate Justice of the Supreme Court (SC).

The JBC will submit its shortlist to President Gloria Macapagal-Arroyo who is mandated by the 1987 Constitution to appoint justices in the Judiciary.

President Arroyo has the sole prerogative to approve or not the shortlist submitted by the JBC for possible appointment of an Associate Justice of the SC.

The vacancies occurred with the early retirement of Associate Justice Conchita Austria-Martinez due to health reasons on April 30, 2009 and Associate Justice Dante Tinga who reached the compulsory mandatory retirement age of 70 on May 11, 2009.

Those who got seven votes each are Court of Appeals (CA) Associate Justice Martin Villarama Jr., Sandiganbayan Associate Justice Francisco Villaluz and former University of Santo Tomas College of Law Dean Roberto Abad.

The others who garnered six votes each are CA Associate Justice Abdulwahid Hakim and Atty. Rodolfo Robles, who is the legal counsel of business tycoon Lucio Tan.

Acting Justice Secretary and concurrent Solicitor General Agnes Devanadera was not included in the shortlist as she was not able to furnish the JBC a clearance from the Office of the Ombudsman.

Devanadera has 17 graft cases now pending before the Ombudsman. (PNA)
